Terms of Service

ExamPrep is operated by Toshi Consulting Services(“ExamPrep”, “we”, “us”). By creating an account or using the ExamPrep website, web app or mobile app (together, the “Service”) you agree to these terms. If you are under 18, a parent, guardian or your school must accept them on your behalf.

1. Accounts

There are four kinds of account: student, teacher, school administrator and platform administrator. School accounts are created by the school; student and teacher accounts under a school are created or approved by that school. Independent students may register directly. You are responsible for keeping your password confidential and for everything done under your account. Tell us at once if you believe it has been used without your permission.

You must give accurate information when you register (including your class and, for schools, the school’s name and address) and keep it up to date.

2. What the Service provides

ExamPrep provides practice questions, adaptive and teacher-set tests, performance analytics, AI-generated reports and an AI tutor for students in Classes 1 to 12, together with tools for teachers and schools to assign, review and monitor that work. Question banks, explanations and AI outputs are learning aids. They are not a guarantee of any exam result, and AI-generated content can be wrong — check anything important against your textbook or teacher.

3. Plans, trials and payment

  • Schools subscribe on a per-student, per-month or per-year basis (Starter, Pro or Enterprise). Every plan allows unlimited students; the plans differ in AI depth, daily test volume and support. Prices shown exclude GST, which is added at the applicable rate and shown on a GST invoice.
  • New school sign-ups get a 14-day trial that does not need a card. When the trial ends the subscription starts only if you choose a plan and pay.
  • Independent students can buy one-time attempt packs. Packs do not renew automatically.
  • Payments are processed by Razorpay. We do not store your card details.
  • Refunds are governed by our Refund Policy.

Plan limits (such as teacher seats and daily test refills) are enforced by the Service, not on an honour basis. We may change prices for new billing periods with at least 30 days’ notice by email or in the app.

4. Acceptable use

You agree not to:

  • share your login or let anyone else sit a test as you;
  • copy, scrape, redistribute or sell question banks, explanations, reports or any other content from the Service;
  • attempt to bypass test integrity controls, attempt limits, plan limits or security measures;
  • upload anything unlawful, abusive or infringing, or use the AI tutor to produce such content;
  • interfere with the Service or other users, or access it by automated means except through interfaces we provide.

Test sessions may be monitored for integrity (for example tab switches and unusual timing). Schools can see those signals for their own students.

5. Content and intellectual property

The Service, its question banks, software, designs and trademarks belong to Toshi Consulting Services or its licensors. You get a limited, non-exclusive, non-transferable licence to use the Service for learning or teaching while your account is active. Tests and questions that teachers create remain the school’s; by uploading them you allow us to store and display them to the students the school assigns them to.

6. Privacy

How we handle personal data, including children’s data, is set out in our Privacy Policy, which forms part of these terms.

7. Suspension and termination

You can stop using the Service at any time; schools can cancel a subscription from Billing and it ends at the close of the paid period. We may suspend or close accounts that breach these terms, and we may suspend a school account for non-payment after notice. A school can deactivate, archive or delete its own student and teacher accounts; deleted accounts are removed permanently after a short grace period.

8. Availability and changes

We work to keep the Service available but do not promise uninterrupted access; maintenance and outages happen. We may add, change or withdraw features. If we withdraw a feature you have paid for, we will tell you and, where it is material, pro-rate or refund the unused portion.

9. Liability

To the extent permitted by law, the Service is provided “as is”. We are not liable for indirect or consequential loss, or for exam outcomes. Our total liability to you for any claim in a 12-month period is limited to the amount you paid us for the Service in that period. Nothing here limits liability that cannot be limited under Indian law.

10. Governing law

These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of the state in which Toshi Consulting Services is registered.

11. Changes to these terms

We may update these terms. The “last updated” date at the top will change and, for material changes, we will notify account holders by email or in the app before they take effect.
